Low velocity impact and fraud update Download > 26 Apr 2012 Following the earlier case of Armstrong and O’Connor v First York (2005), some guidance in relation to dealing with “low velocity impact” (LVI) claims was first given in Kearsley v Klarfield (2005), where it was indicated that Claimants should offer access to their car for early examination and give early disclosure of relevant medical notes. |

Mesothelioma claims and EL policy triggers - Supreme Court judgment Download > 28 Mar 2012 The long awaited Supreme Court judgment in the EL trigger litigation was handed down on 28 March. The Supreme Court found against insurers Excess, MMI, BAI and Independent and their interpretation of their policies. An injury was “sustained” or “contracted” when it was caused or initiated, even if only developed subsequently. |
